Hakkemni ("Hakkemni," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, share, and protect your personal data - including your health data - when you use the Hakkemni website, mobile applications, the Hakkemni health companion, Hakkemni Pro, and all related services (together, the "Platform").

By creating an account or using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Platform.

Important: Because Hakkemni processes health information, we treat your data with a heightened standard of care. Health data is considered sensitive data under applicable data protection laws, and we process it only with your consent or as otherwise permitted by law.

1. Who We Are

Hakkemni is a digital health platform that helps individuals understand and manage their health, and helps healthcare professionals manage their practice. Hakkemni is the data controller for personal data processed through the Platform, except where a healthcare professional using Hakkemni Pro processes their own patients' data, in which case that professional acts as the data controller and Hakkemni acts as a data processor on their behalf.

2. Information We Collect

2.1 Information you provide directly
• Account information: name, email address, phone number, date of birth, gender, password, and profile details.
• Health information (patients): medical records, documents, and images you upload; symptoms, conditions, medications, allergies, and other health details you enter; questions and messages you send to the Hakkemni health companion; appointment history; and any information you choose to share with healthcare providers through the Platform.
• Family profile information: if you create profiles for family members (once available), the personal and health information you provide about them. You confirm you are legally authorized to provide this information (e.g., as a parent or legal guardian).
• Professional information (healthcare providers): credentials, specialties, certifications, clinic details, working hours, location, fees, photos, social media links, team member details, and verification documents.
• Payment information (Hakkemni Pro subscribers): billing details processed through third-party payment providers. Hakkemni does not store full payment card numbers.
• Communications: messages exchanged through the Platform's messaging features, support requests, and feedback.

2.2 Information collected automatically
• Device and technical data: device type, operating system, browser type, IP address, device identifiers, language settings, and app version.
• Usage data: pages and features used, interactions with the Platform, session duration, crash logs, and diagnostic data.
• Cookies and similar technologies: see Section 9.

2.3 Information from connected devices and third parties
• Connected health devices: if you choose to connect a smartwatch, fitness tracker, or other compatible health accessory, we collect the data you authorize, such as activity, sleep, and heart-rate data. You can disconnect a device at any time.
• Healthcare providers: providers may add information to your record in connection with your care, such as appointment notes and documents.
• Integrations: if a healthcare provider integrates Hakkemni Pro with their existing practice management software, data may be exchanged between systems as configured by that provider.

3. How We Use Your Information

We use personal data to:

1. Provide the Platform - create and manage accounts, store your health records, enable appointment booking and reminders, and facilitate communication between patients and healthcare providers.
2. Operate the Hakkemni health companion - analyze the health information, records, and connected-device data you provide in order to answer your questions, generate personalized insights and suggestions, recommend checkups, and help you find appropriate care. The health companion uses automated processing, including artificial intelligence, to generate its responses. Its output is informational only and is not medical advice, diagnosis, or treatment (see our Terms of Service).
3. Process subscriptions and payments for Hakkemni Pro.
4. Improve and secure the Platform - troubleshoot, develop new features, prevent fraud and abuse, and protect the security and integrity of our systems.
5. Communicate with you - service messages, appointment reminders, support responses, and, with your consent where required, marketing communications (which you may opt out of at any time).
6. Comply with legal obligations - respond to lawful requests and meet regulatory, accounting, and audit requirements.
7. Research and analytics - we may use aggregated or anonymized data (which can no longer identify you) for analytics, research, statistics, and service improvement.

Legal bases (where GDPR or similar laws apply): performance of a contract (providing the Platform), your explicit consent (processing of health data, connected devices, marketing), legitimate interests (security, platform improvement), and legal obligations. You may withdraw consent at any time; withdrawal does not affect processing carried out before withdrawal, but may limit the features we can provide.

4. Artificial Intelligence and Automated Processing

• The Hakkemni health companion processes your health data to generate personalized, informational responses.
• AI-generated content may be incomplete or inaccurate and must never be relied upon as a substitute for professional medical advice.
• Hakkemni does not use the health companion to make decisions that produce legal or similarly significant effects about you without human involvement.
• We do not sell your health data, and we do not use your identifiable health data to train AI models for unrelated purposes without your explicit consent.

5. How We Share Your Information

We do not sell or rent your personal data. We share it only in the following cases:

• With healthcare providers you choose - when you book an appointment, message a provider, or share records with them, the information you share becomes accessible to that provider, who is independently responsible for handling it in accordance with medical confidentiality obligations and applicable law.
• With people you authorize - for example, family members you add or invite, or anyone you choose to export or share your data with.
• With service providers - trusted vendors that host our infrastructure, process payments, provide analytics, send notifications, or support customer service. They may only process data on our instructions and under confidentiality obligations. Health data is hosted on secure, HDS-certified servers.
• With regulators and authorities - when required by applicable law, court order, or governmental request, or to protect the rights, safety, or property of Hakkemni, our users, or the public.
• In a business transfer - if Hakkemni is involved in a merger, acquisition, financing, or sale of assets, personal data may be transferred as part of that transaction, subject to this Privacy Policy or one offering equivalent protection.

Healthcare providers who publish content on the Platform (such as anonymized case images) are solely responsible for obtaining any required patient consent before doing so.

6. Data Security

We implement technical and organizational measures designed to protect your data, including encryption in transit and at rest, access controls, authentication requirements, logging, and hosting of health data on HDS-certified servers in compliance with applicable data protection requirements.

No system is completely secure. You are responsible for keeping your login credentials confidential and for the security of the devices you use to access the Platform. If you believe your account has been compromised, contact us immediately at info@hakkemni.com.

If a personal data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the competent authorities and affected users as required by applicable law.

7. Data Retention

We keep personal data only as long as needed for the purposes described in this Policy:

• Account and health data: for the duration of your account, and afterwards only as required by legal, regulatory, or medical record-keeping obligations.
• Payment and billing records: as required by tax and accounting laws.
• Technical logs: for limited periods necessary for security and diagnostics.

When you delete your account, we delete or irreversibly anonymize your personal data within a reasonable period, except where retention is required by law or needed to establish, exercise, or defend legal claims. Data already shared with a healthcare provider may be retained by that provider under their own legal obligations.

8. Your Rights

Your data is yours. Subject to applicable law, you have the right to:

• Access - view the personal data we hold about you.
• Correction - request that inaccurate or incomplete data be corrected.
• Deletion - request deletion of your personal data or your account.
• Export / Portability - receive your data in a structured, commonly used, machine-readable format.
• Restriction and objection - restrict or object to certain processing, including marketing.
• Withdraw consent - at any time, where processing is based on consent.
• Complain - lodge a complaint with a competent data protection authority.

Many of these actions can be performed directly in the app. Otherwise, contact us at info@hakkemni.com. We may need to verify your identity before acting on a request, and we will respond within the timeframes required by applicable law.

9. Cookies and Tracking Technologies

Our website and Platform use cookies and similar technologies to keep you signed in, remember preferences, analyze usage, and improve services. These may collect information such as browser type, IP address, device identifiers, and interaction data.

Where required by law, we request your consent before placing non-essential cookies. You can manage or refuse cookies through your browser settings or, where available, through our cookie preferences tool. Disabling cookies may affect Platform functionality.

10. International Data Transfers

Your data may be stored or processed in countries other than your own, including countries in the European Union. When we transfer personal data internationally, we apply appropriate safeguards, such as contractual protections and transfer to providers offering an adequate level of data protection, in accordance with applicable law.

11. Children and Family Profiles

The Platform is intended for individuals aged 18 or older. Minors may use the Platform only through an account or family profile managed by a parent or legal guardian, or otherwise with verifiable parental consent. Parents and guardians who create family profiles are responsible for the accuracy of the information they provide and for managing the minor's data. We do not knowingly collect data from minors without such consent; if we learn we have done so, we will delete it.

12. Third-Party Services and Links

The Platform may link to or interoperate with third-party services (such as connected-device platforms, payment providers, or practice management software chosen by healthcare providers). Those services are governed by their own privacy policies, and Hakkemni is not responsible for their practices. Please review their policies before connecting them.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the Platform, our practices, or legal requirements. The "Last Updated" date above will be revised, and where changes are material - particularly changes affecting how we process health data - we will provide reasonable advance notice through the Platform or by email. Continued use of the Platform after the effective date of an updated Policy constitutes acknowledgment of the update; where the law requires your consent for a new processing purpose, we will ask for it.
